Service Description

Kentucky Pest Control provides professional pest management and extermination services to residential and commercial properties throughout the Commonwealth of Kentucky. Our services include, but are not limited to, the inspection, identification, treatment, and monitoring of common household pests such as termites, ants, rodents, bed bugs, cockroaches, spiders, wasps, and other nuisance wildlife. Treatment methods may involve chemical applications, bait systems, trapping, exclusion techniques, and integrated pest management strategies tailored to the specific conditions of your property. Service frequency, duration, and scope will be determined based on the pest type, infestation severity, and environmental factors present at the time of inspection. All services are performed by licensed technicians in accordance with Kentucky Department of Agriculture regulations and applicable federal guidelines. We reserve the right to modify treatment protocols based on seasonal conditions, product availability, and evolving pest pressures without prior notice.

No Guarantee or Warranty

Kentucky Pest Control does not guarantee complete elimination of all pests from your property. Pest biology, environmental conditions, neighboring properties, and factors beyond our reasonable control may affect treatment outcomes. No warranty, express or implied, is provided regarding the permanent eradication of pests or prevention of future infestations. Results may vary based on property characteristics, adherence to preparation and post-treatment instructions, and cooperation with recommended sanitation and structural modifications. Recurring service plans do not constitute a warranty but rather represent ongoing management efforts. Any verbal representations made by technicians are not binding and do not override these written terms. We disclaim all warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by law.

User Responsibilities

As a customer, you are responsible for providing accurate information about your property, pest history, and any health conditions, allergies, or sensitivities of occupants or pets that may be relevant to treatment safety. You must ensure access to all areas requiring treatment, including basements, crawl spaces, attics, and exterior perimeters. Prior to service, you must secure pets, remove food preparation items from exposed surfaces, and follow all preparation guidelines provided by our technicians. Children and pets must remain away from treated areas for the duration specified on service documentation. You are responsible for maintaining structural integrity, addressing moisture issues, and implementing sanitation recommendations provided during service. Failure to comply with these responsibilities may diminish treatment effectiveness and will not constitute grounds for service credit or refund. You must notify us immediately of any adverse reactions, property damage concerns, or pest recurrence following treatment.

Limitation of Liability

To the maximum extent permitted by Kentucky law, Kentucky Pest Control shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, lost profits, or emotional distress. Our total liability for any claim shall not exceed the total amount paid for the specific service giving rise to such claim. We are not responsible for damage to personal property, landscaping, or structural elements that are concealed, inaccessible, or not disclosed prior to service. We assume no liability for pest-related damage occurring before, during, or after treatment, including disease transmission, food contamination, or allergic reactions. This limitation applies regardless of the legal theory asserted, whether in contract, tort, negligence, strict liability, or otherwise.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade names, and proprietary information associated with Kentucky Pest Control are our exclusive property or licensed to us. This includes our website content, marketing materials, service reports, treatment protocols, and customer portal features. You are granted no right or license to reproduce, distribute, modify, or create derivative works from any of our intellectual property without express written consent. Customer feedback and testimonials provided to us may be used for marketing purposes without compensation. Technical information and recommendations provided during service remain our confidential proprietary information and may not be shared with competing pest control providers.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles. Any dispute arising from these terms or our services shall be resolved exclusively in the state or federal courts located in Kentucky. You consent to the personal jurisdiction of such courts and waive any objection to venue in these forums. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these terms is found unenforceable under Kentucky law, the remaining provisions shall continue in full force and effect.

Changes to Terms
